Washington State Restraining Order Laws
When you are the subject of a restraining order, you must obey the terms and conditions laid out by the court. Being subjected to the restrictions of a restraining order does not make you guilty of a crime, but if you disobey the terms of the order, you can be arrested for being in violation.
A first violation is generally charged as a gross misdemeanor and carries penalties of:
- Up to a year in jail and/or
- Up to $5,000 in fines
If you have been convicted of two previous restraining order violations, a third violation will be charged as a Class C felony punishable by up to five years of incarceration and/or fines of up to $10,000. You may also be subjected to community service requirements and/or community supervision.
