    Vacated Conviction 4th Degree Assault
This morning, Wayne Fricke appeared in Thurston County Superior Court and was able to get his client's 4th Degree Assault (Domestic Violence) conviction vacated. The client was thrilled to finally put the unfortunate situation behind him.
    Criminal
Two Restraining Orders Granted Anti-harassment Orders
During two consecutive weeks Lance Hester achieved anti-harassment orders for two separate clients.  One had been the subject of bullying and road-rage harassment by a co-worker; the other’s family had been stalked by a former baby sitter over the course of several months following termination of her services.
    Criminal
    Not Liable Assault
Wayne Fricke defended a client in a civil case who was accused of punching a fellow consumer at an area Safeway Supermarket. After several days of trial, the jury came back with a quick verdict in his client's favor.
    Case Dismissed Case Dismissed

Attorney Wayne Fricke, again, convinced the prosecution to dismiss charges against his client, which would have ended up in him spending the rest of his life in prison, had he been convicted. This was no easy task, but due to his independent investigation and legal motions to the court, he was successful in obtaining medical records and multiple interviews of one of the complaining witnesses, including an in court deposition with the judge present to order her to answer the questions that were asked. Normally, an attorney is entitled to a single interview, but because of the uncooperative witness and his determination to seek justice, he secured five interviews. Based on all of this, and his advocacy on behalf of his client, the prosecution agreed to dismiss the case “in the interests of justice”.

    Frequently Asked Questions
    • Is self-defense a valid defense for assault?
Yes, self-defense can be a valid legal defense against an assault charge. If you reasonably believed it was necessary to use force to protect yourself from harm, this may absolve you of liability. The specifics of self-defense laws can vary by jurisdiction.
    • What happens at an assault court hearing?
During an assault court hearing, the charges will be formally stated, and you or your attorney will have the opportunity to respond. Evidence will be presented by both the prosecution and defense. The goal is to determine guilt or innocence, unless a plea deal is reached prior.
    • How does an assault investigation proceed?
An assault investigation typically begins with the police gathering statements from involved parties and witnesses. They may collect physical evidence and review medical records if injuries are involved. The prosecutor then decides whether there's enough evidence to file formal charges.
    • Can assault charges affect my job?
Yes, assault charges can affect employment, especially if your job involves security clearance or working with vulnerable populations. Employers may view charges as a risk. It's crucial to manage the situation legally and seek penalties that won't result in a conviction on your record.
