How to Properly Handle a DUI Arrest in Washington

We all know that drinking and driving is a bad idea, but unfortunately, mistakes happen.  The actions you take from the moment you see flashing lights in your rearview mirror determine both how your case will be handled and your chances of defending the charge in court.

What to do if you are stopped for DUI:

  1. Do not admit to drinking.  Anything you say can be used against you in court.  You have the right to remain silent.
  2. Cooperate with the police.  There is nothing to be gained by being belligerent or angry.
  3. Refuse the field sobriety tests.  These tests are voluntary and you have the right to abstain.
  4. Do not take the portable breath test.  This test is often unreliable and is inadmissible in court.  A more accurate test of your blood alcohol content will be conducted at the police station.  Portable breath test results are frequently used as probable cause to arrest drivers under suspicion of DUI.
  5. Contact an experienced DUI lawyer.  A lawyer will advise you of the bail process and walk you through the next steps.
